Every hospital that has an emergency department and accepts Medicare or Medicaid reimbursement must follow the federal law and Centers for Medicare & Medicaid Services (CMS) interpretive guidelines on Emergency Medical Treatment and Labor Act (EMTALA). This includes critical access hospitals.

PART I of this program will include the basic concept of EMTALA, who the “players are” and locating the regulations on the internet. Sue will also talk about OCR and EMTALA investigations, various CMS survey memos, EMTALTA definitions and requirement and Joint Commission standards.
